La prescripción como causal de confirmación del matrimonio inicialmente inválido en el distrito judicial de Loreto

Abstract

La presente investigación tiene por finalidad explicar el por qué debería considerarse a la prescripción como una modalidad de confirmación del matrimonio inicialmente inválido. Para ello, hemos estructurado el presente trabajo del siguiente modo: El primer título está referido al planteamiento del problema, sus antecedentes y formulación, los objetivos, justificación, importancia y limitaciones de la investigación. El segundo título contiene el marco teórico de esta investigación; así, consideramos la teoría del acto jurídico, requisitos, diferenciación entre nulos y anulables, convalidación, el matrimonio, requisitos. El tercer título comprende la metodología empleada en la investigación: el tipo y diseño de la investigación, técnicas e instrumentos, población, muestra, diseño estadístico, etc. El cuarto título es propiamente la contrastación de la hipótesis, así como el análisis de los resultados obtenidos. Finalmente, se encuentran las conclusiones y recomendaciones a la que hemos arribado.This research aims to explain why prescription should be seen as a form of confirmation initially invalid marriage. To do this, we have structured this paper as follows: The first title is referred to the statement of the problem, its history and development, objectives, rationale, significance and limitations of the research. The second title contains the theoretical framework of this research; so, we consider the theory of legal act, requirements, differentiation between void or voidable, validation, marriage requirements. The third title includes the methodology used in the research: the type and design research techniques and instruments, population, sample, statistical design, etc. The fourth title is properly the test of the hypothesis and analysis of results. Finally, there are the conclusions and recommendations which have arrived.
