Abstract
Problema: ¿De qué forma el numeral 1 del artículo 521 del Código Procesal Penal, contraviene Derechos fundamentales y los Principios de la Administración de Justicia de la Constitución Política del Perú? Objetivo: Determinar de qué forma el numeral 1 del artículo 521 del Código Procesal Penal, contraviene Derechos fundamentales y los Principios de la Administración de Justicia de la Constitución Política del Perú. Material y Método: Se aplicó un cuestionario estructurado a una muestra de 50 profesionales del derecho por variable, entre Jueces, Fiscales y Abogados. El diseño fue no experimental transversal. Para el análisis estadístico se usó estadística descriptiva. Resultados: el numeral 1 del artículo 521 del Código Procesal Penal contraviene los derechos fundamentales como el derecho a la Libertad y Seguridad Personal, así como los derechos de la Función Jurisdiccional como es de la Independencia Jurisdiccional y la Motivación de las resoluciones judiciales. Conclusión: que el numeral 1 del artículo 521 del Código Procesal Penal colisiona con la Constitución Política del Perú en el literal “f” del numeral 24 del artículo 2 y el inciso 2 y 5 del artículo 139 de la Constitución Política del Perú.
Problem: How does numeral 1 of article 521 of the Criminal Procedure Code con- travene fundamental rights and the principles of the administration of justice of the Political Constitution of Peru? Objective: To determine how numeral 1 of arti- cle 521 of the Code of Criminal Procedure contravenes fundamental rights and the principles of the administration of justice of the Political Constitution of Peru. Material and Method: A structured questionnaire was applied to a sample of 50 law professionals by variable, including Judges, Prosecutors and Lawyers. The design was non-experimental cross-sectional. Statistical analysis was used for statistical analysis. Results: numeral 1 of article 521 of the Code of Criminal Pro- cedure contravenes fundamental rights such as the right to Freedom and Personal Security, as well as the rights of the Jurisdictional Function as it is of Jurisdiction- al Independence and the Motivation of judicial decisions. Conclusion: that para- graph 1 of article 521 of the Code of Criminal Procedure conflicts with the Politi- cal Constitution of Peru in paragraph "f" of numeral 24 of article 2 and paragraphs 2 and 5 of article 139 of the Political Constitution of Peru.
