Abstract
El presente trabajo de investigación parte del problema ¿El indebido cambio del
precedente vinculante en materia de aplicación de principios penales por parte del
Tribunal Constitucional ha causado incongruencias en los fallos y falta de seguridad
jurídica? habiéndonos propuesto como objetivo de investigación: determinar las
principales causas que determinaron los fallos incongruentes en materia de
principios penales del Tribunal Constitucional, así como establecer los efectos que
contrajo esta indebida modificación de los precedentes vinculantes en los fallos
posteriores, ello debido a que se ha comprobado una tendencia al interior del
Tribunal Constitucional de variar de manera contradictoria, incongruente o con
motivación insuficiente algunos de sus precedentes vinculantes, determinándose
que los factores que han influenciado para que esta situación se presente serían, la
falta de consenso entre los integrantes del Tribunal Constitucional respecto de la
observancia de sus propios precedentes vinculantes, así como la falta de
comprensión y aplicación de la regla del cambio de precedente o técnica del
‘Overruling’; a la que se agrega las deficiencias en la argumentación de sus fallos,
para ello se ha utilizado el método Científico – Descriptivo, habiendo obtenido
como resultado que existe un Indebido cambio del Precedente Vinculante como
causal de incongruencia en los fallos del Tribunal Constitucional en materia de
Principios Penales.

Having proposed to us as a research objective: to determine the main causes that determined the incongruous judgments on the criminal principles of the Constitutional Court as well as to establish the effects that contracted this improper modification of the binding precedents in the subsequent judgments, because it has been verified A tendency within the Constitutional Court to vary in a contradictory, incongruous or insufficiently motivated way some of its binding precedents, being determined that the factors that have influenced for this situation to occur would be the lack of consensus among the members of the Constitutional Court regarding Of the observance of its own binding precedents, as well as the lack of understanding and application of the rule of precedent change or technique of Overruling; To which is added the deficiencies in the argumentation of its failures, for this has been used the Scientific - Descriptive method, having obtained as a result that there is an improper change of the Binding Precedent as a cause of incongruity in the decisions of the Constitutional Court in matters of Criminal Principles.
