Abstract
Problema: ¿De qué forma el numeral 6 del artículo 59° – A del Código de
Ejecución Penal colisiona con el Derecho Constitucional del penado? Objetivo:
Determinar de qué forma el numeral 6 del artículo 59° – A del Código de
Ejecución Penal colisiona con el Derecho Constitucional del penado. Material y
Método: Se aplicó un cuestionario estructurado a una muestra de 50 profesionales
del derecho por variable, entre Jueces, Fiscales y Abogados. El diseño fue no
experimental transversal. Para el análisis estadístico se usó estadística descriptiva.
Resultados: El numeral 6 del artículo 59° - A del Código de Ejecución Penal,
colisiona con la reincorporación del penado a la sociedad, toda vez que la revisión
de la cadena perpetua a los 35 años, no garantiza la excarcelación del penado por
estar sujeta a requisitos de procedibilidad y la evolución favorable del interno que
permita apreciar que se ha cumplido con los fines del tratamiento penitenciario,
los cuales no es posible por las condiciones desfavorables de los centros
penitenciarios. Conclusión: Que el numeral 6 del artículo 59° – A del Código de
Ejecución Penal, colisiona con el principio del régimen penitenciario, el cual tiene
por objeto la reeducación, rehabilitación y reincorporación del penado a la
sociedad.

Objective: To determine how numeral 6 of article 59° – A of the Code of Criminal Execution collides with the Constitutional Law of the Defendant. Material and Method: A structured questionnaire was applied to a sample of 50 law professionals by variable, including Judges, Prosecutors and Lawyers. The design was non-experimental cross-sectional. Statistical analysis was used for statistical analysis. Results: Article 59 (A) 6 of the Criminal Enforcement Code collides with the reincorporation of the prisoner in the society, since the revision of the life imprisonment at the age of 35 does not guarantee the release of the prisoner for being subject To procedural requirements and the favorable evolution of the inmate that allows to appreciate that has been fulfilled for the purposes of penitentiary treatment, which is not possible due to the unfavorable conditions of prisons. Conclusion: That paragraph 6 of article 59° – A of the Criminal Enforcement Code collides with the principle that the penitentiary regime is aimed at reeducation, rehabilitation and reincorporation of the prisoner to society.
