Abstract
El problema:¿De qué manera el segundo párrafo del artículo 22 del Código Penal colisiona
con el artículo 2 numeral 2 de la Constitución Política del Estado? Siendo el
objetivo:Explicar de qué manera el segundo párrafo del artículo 22 del Código Penal
colisiona con el artículo 2 numeral 2 de la Constitución Política del Estado. El material y
método de la investigación:Se aplicó un cuestionario estructurado a una muestra de
10 jueces, 10 fiscales y 50abogados por variable, El diseño fue no experimental
transversal. Para el análisis estadístico se usó estadística descriptiva.Siendo el
resultados:Que el segundo párrafo del artículo 22 del Código Penal, colisiona con
el artículo 2 numeral 2 de la Constitución Política del Estado. Llegando a la
siguiente conclusión: Que es necesario realizar una modificatoria al artículo 22 del
Código Penal, debiendo suprimirse el segundo párrafo del artículo antes indicado,
por contravenir expresamente a la Constitución Política del Estado.

For the statistical analysis, descriptive statistics were used. The results being: That the second paragraph of article 22 of the Penal Code collides with article 2, number 2 of the Political Constitution of the State. Reaching the following conclusion: That it is necessary to make an amendment to Article 22 of the Penal Code, the second paragraph of the aforementioned article must be deleted, as it expressly contravenes the Political Constitution of the State.
