El principio de legalidad penal y su vulneración en el delito de sicariato

Abstract

La presente investigación tiene por finalidad, demostrar que el tipo penal de sicariato afecta el principio de legalidad penal, el objetivo fue demostrar que el tipo penal de sicariato mantiene la vigencia de dos normas penales y que estas generan confusión en la sociedad, el diseño fue descriptivo-explicativo, pues buscó demostrar que el tipo penal de sicariato descrito en el D. Leg. No.1181 vulnera el principio de legalidad penal; se utilizó los métodos analítico, deductivo-inductivo, analizando los resultados podemos concluir: que la delincuencia afecta la convivencia social, el sicariato es una amenaza para el Estado, afectando la vida política, económica y social del país y conforme está descrito, es manifiesto y evidente que vulnera el principio de legalidad, conforme a lo expuesto se considera las siguientes recomendaciones: que para diezmar el sicariato no solo se debe realizar acciones represivas como incrementar las penas y agravantes de dicha conducta ilícita, sino que se debe implementar planes de prevención que involucre a todos los sectores que se vinculen al fomento y desarrollo integral de las personas, brindándoles la oportunidad de acceder a una adecuada educación, salud, vivienda y empleos, alcanzando así armonía social. Asimismo, la modificación del artículo 108 del Código Penal, introduciendo las agravantes e incremento de las penas –si se persiste en ello- establecidas en el Decreto Legislativo 1181, cuya eliminación se plantea.

This research aims to demonstrate that the crime of murder for hire affects the principle of legality, the objective was to demonstrate that the crime of murder for hire maintains the validity of two criminal rules and that they generate confusion in society, the design was descriptive and explanatory, as it sought to demonstrate that the crime of killings described in D. Leg. No.1181 violates the principle of legality; inductive deductive-analytical methods, was used, according to the results we conclude: that crime affects social interaction, contract killings is a threat to the state, affecting the political, economic and social life of the country and as described, is manifest and clearly violates the principle of legality, as set forth considered the following recommendations: that to decimate the killings not only must perform repressive actions such as increasing penalties and aggravating circumstances of such unlawful conduct, but must implement prevention plans involving all sectors that are linked to the promotion and integral development of individuals, providing them the opportunity to access to adequate education, health, housing and jobs, thus achieving social harmony. In addition, the amendment of Article 108 of the Criminal Code, introducing aggravating and increased penalties if persisted in it-established in Legislative Decree 1181, the elimination arises.
