Información y participación ciudadana en la fiscalización ambiental del sector hidrocarburos lote 192 (Ex 1AB) en Loreto, 2015

Abstract

La investigación es descriptiva y transversal. La población y la muestra consistió en toda la información referente en acceso a la información, participación ciudadana y fiscalización ambiental administradas por el OEFA relacionados en el ámbito del lote 192 (EX 1AB) PLUSPETROL en el sector Hidrocarburos. El objetivo del estudio fue evaluar los mecanismos de información y participación ciudadana y su influencia en la fiscalización ambiental en el sector hidrocarburos en Loreto. El desarrollo actividades de capacitación de la Oficina Desconcentrada de Loreto de la OEFA, para mejorar la información en el último año ha permitido una mayor participación de la población, lo cual se refleja por el mayor número de denuncias ambientales reportados, con lo cual se verifica y se acepta la hipótesis de la presente investigación. Durante último año (2015) se logra la articulación y ejecución de capacitaciones por parte de la Oficina Desconcentrada de Loreto OEFA, es decir se desarrolla una actividad más dinámica con el fin de mejorar la información en la población local, con lo cual se fortalecieron las capacidades de las comunidades nativas y otras poblaciones vulnerables. En el ámbito de la región Loreto se acreditaron siete (07) Rucefistas (Red Universitaria de Capacitación y Educación en Fiscalización Ambiental), todos estudiantes de la Universidad Nacional de la Amazonia Peruana. Se observa un incremento de participación directa de la población indígena en la presentación de denuncias ambientales. Y además, en el Servicio de Información Nacional de Denuncias Ambientales (CGSINADA) se registran nueve (09) denuncias ambientales en el ámbito del Lote 192 – PLUS PETROL Se reporta que la infracción con mayor frecuencia en el Lote 192 – PLUS PETROL, es la presencia de Productos químicos en área a la intemperie, sin impermeabilización, sin sistema de doble contención y sin señalización, seguido por el Incumplimiento procedimiento administrativo ante los requerimientos de los responsables en materia ambiental. La participación ciudadana en la gestión de proyectos normativos ambientales, no se reportan iniciativas ciudadanas ni proyectos normativos elaborados por la ciudadanía, los proyectos normativos son elaborados por la OEFA. La fiscalización ambiental se reporta desde el 2012 a la fecha, la OEFA ha realizado nueve (09) monitoreos ambientales participativos, y ha emitido diez (10) informes de monitoreo. Asimismo, con respecto a los procedimientos administrativos sancionadores se han emitido quince (15) resoluciones en primera instancia y ocho (08) en proceso de apelación en segunda instancia. De los procedimientos administrativos resueltos se tienen diez con resoluciones de multa en primera instancia y seis (06) con resoluciones en segunda instancia.

In the region of Loreto, seven (07) Rucefistas (University Network of Training and Education in Environmental Control) were accredited, all students of the National University of the Peruvian Amazon. There is an increase of direct participation of the indigenous population in the presentation of environmental complaints. In addition, in the National Environmental Complaints Information Service (CGSINADA), nine (09) environmental complaints are registered in the scope of lot 192 - PLUS PETROL It is reported that the most frequent infringement in Lot 192 - PLUS PETROL is the presence of Chemicals in an open area, without waterproofing, without a double containment system and without signaling, followed by the Non-compliance with the administrative procedure with the requirements of Those responsible in environmental matters. Citizen participation in the management of environmental normative projects, no citizen initiatives or normative projects elaborated by the citizens are reported, normative projects are elaborated by the OEFA. Environmental monitoring is reported from 2012 to date, the OEFA has conducted nine (09) participatory environmental monitoring, and issued ten (10) monitoring reports. Likewise, fifteen (15) resolutions have been issued in the first instance and eight (08) in the process of appeal in second instance. Of the administrative procedures resolved, there are ten with resolutions of fine in first instance and six (06) with resolutions in second instance.
