El tipo penal de feminicidio y la vulneración del principio de legalidad del sentenciado en el distrito judicial de Loreto 2014-2018

Abstract

Objetivo. Determinar si el tipo penal de feminicidio respecto al cuanto de la pena vulnera el principio de legalidad del sentenciado en el distrito judicial de Loreto 2014 al 2018. Material y métodos. Se aplicó un cuestionario estructurado de 09 ítems a una muestra de 30 abogados litigantes en un estudio de tipo cuantitativo, de diseño no experimental. Resultados: El valor X2 se obtuvo del software estadístico SPSS. Se tiene, que de acuerdo a la Tabla 10, el X2 es significativo. X2 = 10,23 > 3,84; p=0,001< 0,05; por lo que se rechaza Ho. Conclusión: El tipo penal de feminicidio respecto al cuanto de la pena vulnera significativamente el principio de legalidad del sentenciado en el distrito judicial de Loreto 2014 al 2018.

Material and methods. A structured questionnaire of 09 items was applied to a sample of 30 trial lawyers in a quantitative, non-experimental design study. Results: The X2 value was obtained from the statistical software SPSS. We have, that according to Table 10, the X2 is significant. X2 = 10.23> 3.84; p = 0.001 <0.05; so it is rejected Ho. Conclusion: The criminal type of feminicide with respect to the amount of the sentence significantly violates the principle of legality of the sentenced person in the judicial district of Loreto 2014 to 2018.
