Requisito del pago de pensión alimenticia para demandar régimen de visitas en los juzgados de familia de Maynas 2022

Abstract

In 2022, the First and Second Family Courts of Maynas handled visitation rights cases filed by parents without parental authority. Article 88 of the Children and Adolescents Code requires proof of payment of child support or the impossibility of fulfilling it to grant visitation rights. However, Article 4 of the Political Constitution of Peru guarantees the child’s right to maintain a relationship with the non custodial parent. This basic research, with a qualitative approach and descriptive design, had a population of 16 legal operators and a sample of 10, who were interviewed through structured questionnaires and analyzed using documentary techniques. The study aimed to determine whether the child support requirement was applied, whether it infringes the principle of the best interests of the child, and whether it affects access to effective judicial protection. Findings revealed that in 2022, compliance with Article 88 was not required, and that its enforcement may violate the best interests of the child, access to justice, and legal certainty. It is concluded that this legal provision should be amended to ensure the protection of these rights.

En el Primer y Segundo Juzgado de Familia de Maynas, en 2022, se tramitaron procesos de régimen de visitas promovidos por padres sin patria potestad. El artículo 88 del Código de los Niños y Adolescentes exige acreditar el pago de pensiones alimenticias o la imposibilidad de cumplirlo para otorgar dicho régimen; sin embargo, el artículo 4° de la Constitución garantiza el derecho del menor a relacionarse con el progenitor con quien no vive. La investigación, de tipo básico, enfoque cualitativo y diseño descriptivo, tuvo como población 16 operadores jurídicos y como muestra 10, entrevistados mediante cuestionarios y analizados con técnica documental. Se buscó determinar si se exigió el requisito alimentario, si ello vulnera el interés superior del niño y si afecta la tutela jurisdiccional efectiva. Se halló que en 2022 no se exigió el cumplimiento del artículo 88, y que su aplicación afecta el interés superior del niño, el acceso a la justicia y la seguridad jurídica. Se concluye que es necesario modificar esta disposición legal para garantizar dichos derechos.
