Procedimiento de sucesión intestada en vía notarial y vulneración del derecho a la herencia en Iquitos, 2023

Abstract

The purpose of this thesis is to determine whether or not what is regulated in Law No. 26662 - “Law of Notarial Competence in non-contentious matters” violates the right to receive an inheritance, that is, to determine whether article 39 satisfies the essential requirements for the exercise of the right to inheritance, in addition, examine the consequences of notarial intervention when there is more than one heir and one is harmed by the request, which is made unilaterally, and propose new criteria that improve the procedure. After a detailed and descriptive analysis, it has been revealed that the majority of those interviewed consider that the procedure for the notarial declaration of heirs does violate the right to inheritance. According to the analysis, it is concluded that the requirements established in the Law violate the right to inheritance, since, since there is a person who considers himself to have the right to it, he must go to court, consequently, being immersed in a tedious judicial process.

El propósito de esta tesis es determinar si lo regulado en la Ley N° 26662 - “Ley de Competencia Notarial en Asuntos No Contenciosos” vulnera o no el derecho a recibir una herencia, esto es, determinar si el art. 39 satisface los requisitos esenciales para el ejercicio del derecho a la herencia, además, examinar las consecuencias de la intervención notarial cuando exista más de un heredero y alguno resulte perjudicado por la solicitud, que es realizada de manera unilateral, y proponer nuevos criterios que mejoren el procedimiento. Después de un análisis detallado y descriptivo se ha revelado que la mayoría de entrevistados consideran que el procedimiento para la declaratoria de herederos notarial sí vulnera el derecho a la herencia. Según el análisis, se concluye que los requisitos establecidos en la Ley vulneran el derecho a la herencia, puesto que, al existir una persona que se considere tener derecho sobre la misma, deberá acudir a la vía judicial, por consiguiente, verse inmerso en un tedioso proceso judicial.
