Fundamentos en archivo de denuncias de delitos de agresiones contra la Mujer e integrantes del Grupo Familiar de Maynas, en la fiscalía especializada-2024

Abstract

The Provincial Corporate Prosecutor’s Office Specialized in Crimes of Violence against Women and Members of the Family Group of Maynas has exercised its sanctioning function against all forms of violence; however, many investigations involving physical and psychological aggression are dismissed. Therefore, this thesis aims to identify the main legal grounds on which prosecutors ordered the dismissal of criminal investigations in 2024, within the framework of Plenary Agreement No. 2-2005/CJ-116. As a result, it was found that the Prosecutor’s Office dismissed investigations because the alleged victims did not wish to continue, failed to cooperate, or did not appear despite being duly summoned. The prosecutors based the dismissal on the non-compliance with the guarantees of certainty, especially the lack of plausibility and persistence in the accusation. The lack of plausibility occurs because the alleged facts are not corroborated by the victim or by other elements of conviction. The lack of persistence arises because victims are economically or emotionally dependent on the aggressor, reconcile with them, or abandon the proceedings. In this regard, the study proposes to highlight these legal grounds in order to improve victim assistance and fulfill the purpose of the Specialization Law.

La Fiscalía Provincial Corporativa Especializada en Delitos de Violencia contra la Mujer y los Integrantes del Grupo Familiar de Maynas ha ejercido la función sancionadora frente a toda forma de violencia; sin embargo, muchas investigaciones por agresiones físicas y psicológicas devienen en archivo. Por ello, la tesis tiene como objeto identificar los principales fundamentos jurídicos por los cuales los fiscales dispusieron el archivo de investigaciones fiscales en 2024, enmarcándolos en los presupuestos del Acuerdo Plenario N.° 2-2005/CJ-116. Como resultado, se obtuvo que la Fiscalía archivó investigaciones porque las presuntas víctimas no desean continuar, no colaboran o no asisten pese a estar válidamente citadas. Los magistrados fundamentan el archivo en el incumplimiento de las garantías de certeza, especialmente en la falta de verosimilitud y persistencia en la incriminación. La falta de verosimilitud se presenta porque los hechos imputados no son corroborados por la víctima ni por otros elementos de convicción. La falta de persistencia ocurre porque las víctimas dependen económica o emocionalmente del agresor, se reconcilian o abandonan las diligencias. Ante ello, se propone evidenciar estos fundamentos para mejorar la atención a las víctimas y cumplir el objeto de la Ley de la Especialidad.
