Abuso de derecho en función a letras de cambio incompletas en los procesos únicos de ejecución en la provincia de Maynas periodo 2022–2023

Abstract

La tesis analiza el abuso del derecho en letras de cambio incompletas dentro de los procesos únicos de ejecución en la provincia de Maynas, en el periodo del 2022-2023. El Problema se formula como: ¿qué modificaciones requiere la ley de títulos valores para garantizar la seguridad jurídica del obligado ante abusos en el llenado arbitrario de letras de cambio incompletas? Mientras que los objetivos buscan proponer reformas normativas para mitigar estos abusos, evaluando las condiciones actuales que los generan y las deficiencias del proceso único de ejecución que no protegen al deudor. Metodológicamente, se adopta un enfoque cualitativo básico, descriptivo-interpretativo y no experimental, mediante análisis documental de 40 autos finales y datos estadísticos de 851 expedientes judiciales de la Corte Superior de Justicia de Loreto. Los resultados arrojan un incremento de procesos, de los cuales el 100% han sido declarados fundados, mayormente sin contradicción, con un solo caso de oposición rechazada por falta de prueba de los acuerdos vulnerados, evidenciando asimetrías que favorecen al acreedor y vulneran la buena fe. Se concluye que la flexibilidad del artículo 10 de la ley de títulos valores facilita abusos sistemáticos, comprometiendo la seguridad jurídica, por lo que se proponen modificaciones como la obligatoriedad de anexar acuerdos al título valor y la inversión de la carga probatoria, junto con recomendaciones para una interpretación extensiva de la buena fe.
This thesis analyzes the abuse of rights in incomplete bills of exchange within the single enforcement proceedings in the province of Maynas, during the period of 2022-2023. The research question is: what modifications does the law on negotiable instruments require to guarantee the legal security of the obligor against abuses in the arbitrary completion of incomplete bills of exchange? The objectives are to propose regulatory reforms to mitigate these abuses, evaluating the current conditions that generate them and the deficiencies of the single enforcement proceeding that fail to protect the debtor. Methodologically, a basic, descriptive-interpretative, and non experimental qualitative approach is adopted, using documentary analysis of 40 final rulings and statistical data from 851 court records of the Superior Court of Justice of Loreto. The results show an increase in legal proceedings, 100% of which were declared valid, mostly without objection, with only one case of opposition rejected due to lack of evidence of the violated agreements. These findings reveal asymmetries that favor the creditor and violate good faith. It is concluded that the flexibility of Article 10 of the Securities Law facilitates systematic abuses, compromising legal certainty. Therefore, modifications are proposed, such as requiring the attachment of agreements to the security and reversing the burden of proof, along with recommendations for a broader interpretation of good faith.
