El proceso común y su viabilidad de la aplicación de la terminación anticipada en etapa intermedia período 2021-2022

Abstract

The objective was to determine whether applying early termination of proceedings during the preliminary hearing stage is viable. Specific objectives included analyzing whether it violates the principle of procedural legality and identifying the criteria used by judges of preliminary investigation regarding its application in the indictment review. This quantitative, descriptive, and analytical research is dogmatic in nature, as it examines the viability of early termination at the indictment review stage and the decision-making stance of the jurisdictional body. Therefore, it can be concluded that an incorrect application of early termination in the indictment review stage would lead to its inadequate viability, violating fundamental rights and procedural principles.

Como objetivo fue determinar sí aplicando terminación anticipada en intermedia es viable o no, como objetivos específicos son, analizar si se vulnera el principio de legalidad procesal, así como identificar cuáles son los criterios que vienen asumiendo los jueces de investigación preparatoria, en relación a su aplicación en el control de acusación. Investigación cuantitativa, descriptivo, analítico, y por su estudio es de investigación dogmática, toda vez que estudia la viabilidad o no de la terminación en el estadio del control de acusación, así como la postura de las decisiones del órgano jurisdiccional. Siendo así, se puede afirmar que una incorrecta aplicación de la terminación anticipada en el control acusatorio, influiría en una inadecuada viabilidad en su planteamiento, vulnerando derechos fundamentales y principios procesales.
