La gestación subrogada en los juzgados de familia de Maynas 2022

Abstract

The thesis aims to describe surrogacy in the family courts of Maynas in 2022 from the three-dimensional theory of law to address the processes related to this legal figure. It consisted of a basic qualitative research approach, with a sample of four focus groups made up of twenty-four lawyers working in the family courts of Maynas. As a result, the participants have the notion that surrogacy is a figure that is not regulated in the Peruvian legal system; however, many individuals or couples, for reasons such as infertility and aesthetic concerns, have resorted to this treatment thanks to advances in medical science. Nevertheless, they hold divided positions: some oppose it because it goes against the principles and values upheld by the Catholic Church, while those in favor argue that it should be regulated to prevent abuse of this practice. Thus, we conclude that they have a multidisciplinary, holistic, or intuitive understanding of surrogacy, which aligns with the authors referenced in this research, prompting the need for regulation to prevent the violation of rights for those involved, particularly the unborn child.

La tesis tiene como objetivo describir la gestación subrogada en los juzgados de familia de Maynas en el 2022 desde la teoría tridimensional del Derecho para abordar los procesos relacionados a esta figura jurídica, consistió en una investigación Básica de enfoque cualitativo, la muestra fue cuatro grupos de enfoque integrada por veinticuatro abogados que laboran de los juzgados de familia de Maynas; Como resultado los participantes consideran que la gestación subrogada es una figura que, no está regulado en el ordenamiento jurídico peruano, sin embargo, muchas personas o parejas por razones de infertilidad, estéticas entre otras, han recurrido a este tratamiento gracias al avance de la ciencia médica. Sin embargo, tienen posturas divididas, algunos se oponen porque va en contra de los principios y valores que rigen la iglesia católica y los que están a favor sostienen que se debe regular para evitar el abuso de esta práctica; así concluimos que tienen una visión multidisciplinaria, holística o intuitiva sobre la Gestación Subrogada la cual guarda concordancia con los autores de los antecedentes de esta investigación, lo que impulsa a que se regule la gestación subrogada para evitar la vulneración de derechos de los intervinientes, principalmente la del niño que esta por nacer.
